BILL INTRODUCED IN GEORGIA TO BAN STICKERED ALBUMS
TO MINORS
A bill has been introduced in the Georgia State House of Representatives (HB 1170) which will make it a misdemeanor for anyone to sell a sound recording bearing the RIAA's parental advisory label to any person under the age of 18. Yesterday, 1/13/98, the bill was sent to the House Judiciary Committee for consideration. We must write to the members of that committee protesting the enactment of this bill and urging their support of musicians and fans First Amendment rights.

A BILL TO BE ENTITLED
AN ACT
1 To amend Part 3 of Article 3 of Chapter 12 of Title 16 of
2 the Official Code of Georgia Annotated, relating to the sale
3 or distribution of harmful material to minors, so as to
4 restrict the sale of certain sound recordings to minors; to
5 provide a penalty; to repeal conflicting laws; and for other
6 purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
9 Part 3 of Article 3 of Chapter 12 of Title 16 of the
10 Official Code of Georgia Annotated, relating to the sale or
11 distribution of harmful material to minors, is amended by
12 inserting at the end thereof the following:
13 "16-12-106.
14 (a) It shall be unlawful for any person engaged in the
15 business of selling sound recordings to the public for a
16 profit to sell to any person under the age of 18 years any
17 sound recording bearing the parental advisory logo imposed
18 by the Recording Industry Association of America
19 identifying the sound recording as containing strong
20 language or expressions of violence, sex, or substance
21 abuse.
22 (b) Any person found guilty of violating the provisions of
23 this Code section shall be punished as for a misdemeanor."

SECTION 2.
25 All laws and parts of laws in conflict with this Act are
26 repealed.
